This Privacy Policy applies to all DrowsyFox LLC games including Break Orbit available on Apple App Store (IOS) and Google Play Store (Android), the websites including drowsyfox.com and drowsyfox.com (collectively “Site”) and other related services (collectively “Services”). Throughout this document, the terms “we”, “us”, “our”,“DrowsyFox™” and “Break Orbit” refer to Drowsy Fox LLC which is operated from Virgina, USA.

Games comprise of our video game softwares (“Game”), the associated media, any software associated with the online mode of the video Game, any printed materials, manuals, any online or electronic documentation, and any and all copies of such software and materials developed by DrowsyFox LLC.  

We have prepared this policy to better serve those who are concerned with how their ‘Personally Identifiable Information’ (PII) is being used online. PII, as described in US privacy law and information security, is information that can be used on its own or with other information to identify, contact, or locate a single person, or to identify an individual in context. Please read our privacy policy carefully to get a clear understanding of how we collect, use, protect, or otherwise handle your PII.

For US residents, we adopt this notice to comply with the California Consumer Privacy Act of 2018 (“CCPA”) and other US privacy laws applicable to our jurisdiction.  Any terms defined in the CCPA have the same meaning when used in this Policy. For users from Europe, see below “General Data Protection Regulation of 2018 (GDPR), (EU) 2016/679. 

By using the Services, you agree to the collection and use of information in accordance with this policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms and Conditions.

INFORMATION YOU GIVE TO US

We collect information you give to us, such as when you:

  • download, update and play our games;

  • enter our competitions;

  • are involved in our special events (e.g. focus testing days);

  • enter any information on our Website or on the Game;

  • make an in-app purchase;

  • request technical support, make a compliment or complaint, or otherwise contact us directly; or

  • give us your information in another way.

INFORMATION COLLECTED AUTOMATICALLY

We receive and store certain types of information automatically when you interact with us, such as:

  • information about how you use our Services. We use this information to design new Services, improve our games, provide social features and to deliver our Services to you;

  • information about the device you use to access our Services such as its make & model, operating system version, platform, language, time zone, device carrier, applications installed and IP address;

  • the advertising ID for your device. You can reset the advertising ID at any time through your device settings.

  • your general location location (ie. city/country) based on your IP Address, so we know what language to use and so that we can provide Services that are applicable to your location; and

  • if you "tell a friend," "email this page," or use another similar features, we will collect information to perform this feature for you.

INFORMATION FROM THIRD PARTIES

Sometimes we collect information about you from third parties, such as Apple, Amazon, Facebook, or Google. We collect this information so that we can deliver Services you have requested. We collect this information:

  • when you purchase our Services via the App Store, Google Play Store;

  • if you log into our Services through a social media account (such as Facebook) we will collect your basic profile information such as your name, current profile picture, age-range, and your friend list, this lets you interact with your friends who are also using our Services; and

  • when you use in-app features such as Game Center we will collect information such as your user name and your gameplay information.

HOW DO WE USE YOUR INFORMATION?

How we use your personal data

  • So you can play our games

Enjoyable games are a complex business. We work with vendors and partners who give us the technical abilities that let you play and enjoy our games, and to run the business that supports those games.

  • For product support, development and improvement

We use personal data to provide customer support, to improve our games, and to develop new games. We use personal data for playtesting as well as customer and market insight.

  • To provide advertisements to you

We use personal data to provide advertisements to you, both in our games and via related platforms. Sometimes we use personal data to deliver ads based on your interests.

  • To market our products to you

We use personal data to market our games to you such as by email, social media, push-notifications and other methods.

  • To perform our own analytics

We perform analytics on personal data we hold for business analysis and operations, business intelligence, product development and improvement, personalizing content, providing advertising, and making recommendations.

  • We may combine information about you that we have collected from multiple sources

When we share your personal data

  • To deliver advertising to you

We share your advertising ID with our advertising partners. We may also share demographic information about you, and your likes and interests, to allow our partners to provide more relevant advertising to you.

  • To better understand our customers

We may share your personal data with our analytics & attribution partners. This allows us to better understand our customer base and improve product development and revenues. Our analytics & attribution partners may combine the personal data we provide to them with information about you from other companies, to create richer more meaningful data sets.

  • To help us run our business

We provide your personal data to partners who assist us run our business, such as hosting providers, platforms, and payment processors. We also work with certain partners, such as other game developers and advertising partners, and information collected from you may be shared through these partnerships.

  • When you access social media when playing our games

When you play our games you can choose to access social media platforms such Facebook, Twitter, Google+, Game Center and others. If you choose to connect with these platforms, we will share certain personal data with them to enable your access. DrowsyFox LLC doesn’t control how you interact with these platforms and you should ensure that you agree to their terms of use and privacy policies.

OTHER SITES AND SERVICES

Our Site/Game may contain links to other websites and online services operated by third parties.  These links are not an endorsement of, or representation that we are affiliated with, any third party.  In addition, our content may be included on web pages or online services that are not associated with us.  We do not control third party websites or online services, and we are not responsible for their actions.  Other websites and services follow different rules regarding the collection, use and sharing of your personal information.  We encourage you to read the privacy policies of the other websites and online services you use.

SECURITY PRACTICES

The security of your personal information is important to us.  We employ a number of organizational, technical and physical safeguards designed to protect the personal information we collect.  However, security risk is inherent in all internet and information technologies and we cannot guarantee the security of your personal information.

INTERNATIONAL DATA TRANSFERS

We are headquartered in the United States and may have service providers in other countries.  Your personal information may be transferred to the United States or other locations outside of your state, province, country, or other governmental jurisdiction where privacy laws may not be as protective as those in your jurisdiction.

Your California privacy rights.  The CCPA grants California residents the following rights.  However, these rights are not absolute, and in certain cases we may decline your request as permitted by law.

    • The categories of sources from which we collected Personal Information.

    • The business or commercial purpose for collecting and/or selling Personal Information.

    • Whether we have disclosed your Personal Information for a business purpose, and if so, the categories of Personal Information received by each category of third party recipient.

  • Access. You can request a copy of the Personal Information that we have collected about you during the past 12 months.

  • Deletion. You can ask us to delete the Personal Information that we have collected from you.

You are entitled to exercise the rights described above free from discrimination in the form of legally prohibited increases in the price or decreases in the quality of our Service.

How to exercise your California rights.  You may exercise your California privacy rights described above as follows:

  • Right to information, access and deletion. You can request to exercise your information, access and deletion rights by emailing privacy@drowsyfox.com.  We reserve the right to confirm your California residence to process your requests and will need to confirm your identity to process your requests to exercise your information, access or deletion rights.  As part of this process, government identification may be required.  Consistent with California law, you may designate an authorized agent to make a request on your behalf. In order to designate an authorized agent to make a request on your behalf, you must provide a valid power of attorney, the requester’s valid government-issued identification, and the authorized agent’s valid government issued identification.  We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.

  • Request a list of third party marketers. California’s “Shine the Light” law (California Civil Code § 1798.83) allows California residents to ask companies with whom they have formed a business relationship primarily for personal, family or household purposes to provide certain information about the companies’ sharing of certain personal information with third parties for their direct marketing purposes during the preceding year (if any).  You can submit such a request by sending an email to privacy@drowsyfox.com with “Shine the Light” in the subject line.  The request must include your current name, street address, city, state, and zip code and attest to the fact that you are a California resident.

We cannot process your request if you do not provide us with sufficient detail to allow us to understand and respond to it.

GENERAL DATA PROTECTION REGULATION (GDPR)

If you are from the European Economic Area (EEA), our legal basis for collecting and using the personal information described in this Privacy Policy depends on the Personal Data we collect and the specific context in which we collect it.

  • The processing is in our legitimate interests and it’s not overridden by your rights

The security of your data is important to us. Please note that no method of transmission over the Internet, or method of electronic storage is 100% secure. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

If you are a resident of the European Economic Area (EEA), you have certain data protection rights. Break Orbit aims to take reasonable steps to allow you to correct, amend, delete, or limit the use of your Personal Data.

  • The right to access, update or to delete the information we have on you.  If you are unable to perform these actions yourself, please contact us to assist you.

  • The right to withdraw consent. You also have the right to withdraw your consent at any time where Break Orbit relied on your consent to process your personal information.

Service Providers

We may employ third party companies and individuals to facilitate our Service (“Service Providers”), to provide the Service on our behalf, to perform Service-related services or to assist us in analyzing how our Service is used.

These third parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

THIRD PARTIES

We may use third-party Service Providers to monitor, improve, promote and analyze the use of our Service.

  • Google Firebase Analytics

We may use a tool called “Google Firebase Analytics” to collect information about the use of the Services. Google Firebase Analytics collects information such as how often users visit the Services, what pages they visit when they do so, and what other websites they used prior to coming to the Services. Google Firebase Analytics collects only the IP address assigned to you on the date you visit the Services, rather than your name or other identifying information. We do not combine the information collected through the use of Google Firebase Analytics with personally identifiable information. We use the information we get from Google Firebase Analytics only to improve our Services. We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page.
